L’entreprise a d’abord démarré avec le fromage Pied-de-Vent des Iles-de-la-Madeleine et rapidement l’intérêt des artisans fromagers et négociants a conduit à la création d’un réseau représentant aujourd’hui une quinzaine de fromageries artisanales, 1 fabricant de fondue et un charcutier.

Nouvelle disposition législative relative aux accords de fixation des salaires et de non-débauchage

Le Bureau de la concurrence est un organisme d’application de la loi indépendant qui protège et favorise la concurrence au profit des consommateurs et des entreprises canadiennes. La concurrence entraîne une baisse des prix et l’innovation tout en alimentant la croissance économique.

Le Bureau de la concurrence s’emploie à soutenir et à protéger les Canadiens en favorisant un marché concurrentiel et innovateur. Pour ce faire, ils utilisent diverses méthodes, notamment le promotion, la sensibilisation, les consultations, les partenariats et l’application de la loi.

En juin 2022, le gouvernement du Canada a apporté des modifications à la Loi, notamment en ajoutant le paragraphe 45(1.1) aux dispositions existantes sur le complot criminel. Ce nouveau paragraphe protège la concurrence sur les marchés du travail en interdisant les accords entre employeurs pour fixer les salaires et restreindre la mobilité professionnelle. À l’instar des accords entre concurrents concernant la fixation des prix, la répartition des marchés et les restrictions de production, les accords de fixation des salaires et de non-débauchage minent la concurrence et l’allocation efficace des ressources. Le maintien et l’encouragement de la concurrence entre les employeurs se traduisent par des salaires et traitements plus élevés, ainsi que par de meilleurs avantages sociaux et opportunités d’emploi pour les employés.

Aujourd’hui, nous rencontrons Majid Charania, directeur de la conformité. L’unité est chargée de promouvoir le respect de la Loi sur la concurrence et aujourd’hui, ​nous allons discuter d’une nouvelle disposition législative qui porte sur les accords de fixation des salaires et de non-débauchage.

Competition Bureau – June 22, 2023, new legal provisions come into force

The Competition Bureau is an independent law enforcement agency that protects and promotes competition for the benefit of Canadian consumers and businesses. Competition drives lower prices and innovation while fueling economic growth.

The Competition Bureau works to support and protect Canadians by fostering a competitive and innovative marketplace. They do this using various methods, including advocacy, outreach, consultations, partnerships, and enforcement.

In June 2022, the Government of Canada made changes to the Act, including adding subsection 45(1.1) to the existing criminal conspiracy provisions. This new subsection protects competition in labour markets by prohibiting agreements between employers to fix wages and restrict job mobility. Like agreements between competitors related to price-fixing, market allocation and output restrictions, wage-fixing and no-poaching agreements undermine competition and the efficient allocation of resources. Maintaining and encouraging competition among employers results in higher wages and salaries, as well as better benefits and employment opportunities for employees.

Today we’re meeting with Majid Charania, Director of Compliance. The unit is responsible for promoting compliance with the Competition Act and today we’re going to discuss a new section of the law that prohibits wage fixing and no poaching agreements.
